These Terms & Conditions (“Terms”) govern the services provided by Track Your Memories, a trading name of Track Your Memories, with its registered office located in Belgium. By placing an order with us, you confirm that you agree to these Terms.

Article 1 – Definitions

In these Terms & Conditions, the following terms will have the meanings described below:

  • Agreement: The contract between Track Your Memories and the Buyer for the custom vinyl record service, which includes these Terms.
  • Buyer: The individual or business entity placing an order with Track Your Memories.
  • Content: Any data, text, images, audio files, or materials provided by the Buyer to be used in the custom vinyl production.
  • Intellectual Property Rights: All rights related to intellectual property, such as copyrights, patents, trademarks, and design rights.
  • Music Tracks: The music catalog available on the Website, from which the Buyer can select tracks to include in their custom vinyl record.
  • Order Process: The digital procedure on the Website where the Buyer selects the desired music tracks and uploads the necessary Content for the album cover.
  • Privacy Policy: The privacy policy that outlines how we process your personal data.
  • Product: The custom vinyl record made by Track Your Memories for the Buyer as a result of the service provided.
  • Service: The custom vinyl creation service offered by Track Your Memories, which involves pressing vinyl records and printing a custom cover based on the Buyer’s selections.
  • Website: The website of Track Your Memories, accessible at www.trackyourmemories.com.

Article 2 – Execution of the Agreement

  • Track Your Memories commits to fulfilling the Agreement as promptly as possible. However, due to the nature of vinyl production, please note that processing and creation times are estimates and are not guaranteed deadlines.
  • The Agreement will be executed with care and in accordance with industry standards and craftsmanship.
  • We may use third parties to assist in fulfilling the Agreement, but Track Your Memories remains responsible for the overall execution.

Article 3 – Content

  • Track Your Memories does not review or modify the Content provided by the Buyer. The Buyer is fully responsible for ensuring the Content complies with all applicable laws and does not infringe on the rights of third parties.
  • The Buyer guarantees that the Content:
    • Does not violate any intellectual property or privacy rights.
    • Is not offensive, unlawful, or harmful in any way.
    • Does not violate public decency or include inappropriate material.
  • Track Your Memories reserves the right to refuse any Content that does not meet these guidelines, and the Buyer will not be entitled to compensation or damages in such cases.

Article 4 – Pricing and Payment

  • The prices for the Service are listed on the Website at the time of purchase and will apply to the Agreement.
  • All prices are in EUR and include any applicable taxes.
  • The Buyer is required to make full payment before the Service can be processed. The order will only be executed once payment is received.

Article 5 – Intellectual Property Rights

  • By providing Content to Track Your Memories, the Buyer affirms that they hold all necessary rights to the Content or have obtained the required licenses for its use.
  • The Buyer grants Track Your Memories the right to use the Content solely for fulfilling the custom vinyl order.

Article 6 – Liability

  • Track Your Memories is not liable for any damages resulting from the use of the Product, except for defects or damage that occurred during the production or shipping process.
  • Track Your Memories will not be held responsible for indirect damages such as lost profits, sales, or reputational damage.

Article 7 – Warranties and Indemnities

  • The Buyer warrants that the Content provided is free from third-party claims and that it does not infringe on intellectual property or privacy rights.
  • The Buyer agrees to indemnify Track Your Memories for any legal costs, damages, or claims arising from a breach of these warranties.

Article 8 – Privacy and Data Protection

  • Track Your Memories processes the personal data provided by the Buyer in accordance with our Privacy Policy and applicable data protection laws.
  • By using the Website, the Buyer consents to the use of cookies and the processing of their personal data as outlined in the Privacy Policy.

Article 9 – Service Availability

  • Track Your Memories reserves the right to make changes to or temporarily suspend the Service and/or the Website without prior notice.
  • We do not guarantee that the Service or Website will always be available or free from technical issues, and we are not liable for any disruptions.

Article 10 – Cancellation & Return Policy

Due to the custom nature of the Product, once the production process has started, the Buyer cannot cancel, return, or receive a refund unless the Product is defective or damaged upon delivery.

  • Damaged Products: If the Product arrives damaged, the Buyer must notify us within 7 days of receiving the order. We will offer a replacement or refund if the damage is verified.
  • Non-Damaged Products: As the Product is custom-made specifically for the Buyer, cancellations, returns, or refunds are not possible.

Article 11 – Governing Law and Disputes

  • These Terms are governed by the laws of Belgium.
  • Any disputes arising from these Terms shall be resolved in the courts of Belgium.
